Shipment and Risk of Loss
To the extent any product is sold through this Web Site, TFM ships only within the continental United States. Most orders are shipped through the United States Postal Service. If you request overnight delivery, there will an extra charge as defined by the carrier we choose. We will use the USPS or Federal Express, at our discretion, to ship overnight deliveries. The cost for overnight delivery will be charge to you at the time your order is placed.
A business day is defined by Monday through Friday. Orders placed before noon (Eastern Standard Time) Monday through Friday will be shipped the same day. Orders placed after noon (Eastern Standard Time) Monday through Friday will be shipped the following business day. Orders placed on Saturday or Sunday will be shipped out the following Monday or business day in the event of a holiday.
The risk of loss and title for all items purchased through this Web Site pass to you upon TFM’s delivery to the carrier.

Indemnification by You of TFM

TFM reserves the right to seek all remedies available at law and in equity for violations of these Terms, including but not limited to the right to block access from a particular Internet address to this Web Site and/or any of its features.

TFM reserves the right to investigate complaints or reported violations of these Terms and to take any action it deems appropriate, including but not limited to, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties. You agree that TFM may disclose any information, including your Personally Identifiable Information, which it deems necessary, in its sole discretion, to comply with any applicable law, regulation, legal process or governmental request. Jurisdiction and Venue of Disputes

Other Policies, Changes and Severability
If any term, clause or provision of these Terms shall be determined by a court of competent jurisdiction to be void, invalid or unenforceable under applicable law or for any other reason, then only that term, clause or provision as is determined to be void, invalid or unenforceable shall be stricken from these Terms or modified to make it no longer void, invalid or unenforceable. Further, such void, invalid or unenforceable term, clause or provision shall not affect the enforceability of the other terms, clauses or provisions of these Terms, and these Terms shall remain in full force and effect in all other respects.
Notice and Procedure for Making Claims of Copyright Infringement
It is TFM’s policy to comply with the Digital Millennium Copyright Act (“DCMA”), title 17, United States Code, Section 512, including, without limitation, responding to notices of alleged copyright infringement, and other applicable intellectual property laws. In appropriate circumstances, TFM will disable and/or terminate the accounts of users who infringe or repeatedly infringe the copyrights or other intellectual property rights of TFM and/or others.

- Forward the Notification to the alleged infringer (“Subscriber”); and
- Take reasonable steps to promptly notify the Subscriber that TFM has removed or disabled access to the material.
Under the DCMA, a Subscriber may counter a Notification by providing a written communication (“Counter Notification”) to TFM’s designated agent that includes substantially the following:
- A physical or electronic signature of the Subscriber;
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
- A statement under penalty of perjury that the Subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and

Upon receipt of a Counter Notification containing the information outlined above, TFM will, pursuant to the DCMA:
- Promptly provide the Complaining Party with a copy of the Counter Notification;
- Inform the Complaining Party that TFM will replace the removed material or cease disabling access to the removed material within ten (10) business days; and
- Replace the removed material or cease disabling access to the removed material not less than ten (10), nor more than fourteen (14) business days following receipt of the Counter Notification, provided TFM’s designated agent has not received notice from the Complaining Party that an action has been filed seeking a court order to restrain the Subscriber from engaging in infringing activity relating to the removed material on TFM’s network or system.
